Using syphongames.syphondigital.online means you accept what is on this page. It is short on purpose.

1. Using the site

SyphonGames is free to use for personal, non-commercial play. You do not need an account. You do need to not break things.

Do not:

  • Scrape, mirror, or bulk-download the library
  • Re-host our games or embed them elsewhere without the developer's permission
  • Attack the site, probe it, or try to reach the admin panel
  • Automate play counts, ratings, or searches
  • Use the site anywhere it would be against your local law

2. Who owns what

Games published by SyphonGames — which, at present, is all of them — are ours. Our copyright, our code, our art. You may play them here; you may not copy, redistribute, rehost or sell them.

Games submitted by independent developers belong to whoever made them. Their copyright, their trademarks, their code, their art. We host and present those games under licence from the developer; nothing on this site transfers ownership of them to us or to you.

Where a developer asks not to be named, their game is published under the SyphonGames name. That is a credit line and nothing more: an anonymous game still belongs to the person who made it, and they keep every right in it, including the right to have it removed.

The SyphonGames name, logo and site design belong to SyphonGames. Games submitted by others do not.

3. Submitting a game

Submit a game and you are telling us you own it or have the rights to distribute it, and you are giving us permission to host it, show it, and make a thumbnail from it. That permission is non-exclusive, and you can withdraw it whenever you like.

We can decline any submission, take any game down, or edit its listing without notice. Games with malware, cryptominers, injected advertising, stolen assets, or content that breaks Australian law get removed, and the account that uploaded them goes with it.

4. Takedowns

If a game here infringes your rights, email our contact form with the game's URL, what you own, and how to verify that you own it. We action valid claims quickly and we do not argue with the actual rights holder.

5. Games are other people's software

Every game runs in a sandboxed iframe and we screen uploads, but each game is third-party code we did not write. We do not warrant that any game is bug-free, saves your progress, or is suitable for any particular person. If a game misbehaves, tell us and we will look.

6. No warranty

The site is provided as-is. We do not promise it will be available, uninterrupted, or free of errors. We run one small site, not a bank.

7. Liability

To the extent the law allows, SyphonGames is not liable for indirect or consequential loss arising from your use of the site or any game on it.

Nothing in these terms excludes the consumer guarantees in the Australian Consumer Law. Where those guarantees apply and cannot be excluded, our liability is limited to re-supplying the service, or paying for it to be re-supplied. As the service is free, you can work out roughly what that comes to.

8. Changes

We update these terms from time to time. The date at the top moves when we do. Keep using the site after a change and you accept the new version.

9. Governing law

These terms are governed by the laws of Western Australia, and the courts of Western Australia have jurisdiction over any dispute.

10. Contact

General questions, legal notices and takedown requests all go through our contact form. Tell us which it is on the form and it gets routed accordingly — takedowns are actioned first.
